If a tree falls over a property line can you cut it? I know contacting the owner would be the right thing.

If its laying in our field, I cut it up right to the fence line and leave whats on their side.

I had a tree come down on a far corner of the property.  I was in the process of dealing with it when a neighbour comes over and asks if he can "buck it up" and burn it.  No problem, knock yourself out.  Said neighbour bucks it up them starts to help himself to some dead standing trees on the other side of my property line.  A second neighbour comes over and starts to complain.  I get dragged into this 'cause I was misunderstood.  Everyone goes home mad but otherwise no harm done.
First small irony - the dead standing trees were owned by yet another neighbour - a vacant landowner who could probably care less if they were taken or not.
Second bigger irony - the dead standing trees blew down that winter, onto my property, and I spent hours dealing with them.

I do if I know the neighbor, problem out here is even being a rural setting seems like properties are constantly changing hands. I have a ten acre chunk the only reason I farm it is it buts up to other land we own, it has changed hands 3 times in less than ten years.

I have asked the owner about cutting some oak branches the fell of som MONSTER oak, he said no problem, but someone had been cutting some of his best wood and the state Rangers have been around a lot. The Ranger did tell me he knows about the oak branches that I am cutting, but I think I will get something in writing before I continue. I have to get a photo of these oak to post.

I know if their tree falls and damages something on your property,they are not liable. Unless you have it on record of the potential damage it may cause and have asked them to take care of it before it  causes the damage.

I have good neighbors, they told me if it is leaning my way, cut it before building any new fences.  :thumbup:

I've checked again with the neighbors the last week or so, the one woods on the property butts up against two other woods on separate owners properties, have a creek that meanders along thru all three woods but mainly cuts thru the other two, both property owners said if it's dead and on my side to go ahead and cut it up as they can't get to it anyways, this has been a long standing agreement that I've had for 15 years or better. The one neighbor is getting older so wanted to double check in case he forgot.

My other neighbors rock maple is dying, 5 to 6 trees a year. He said i could have it as long as the branches are cut up small.
By the time i get to it there are no branches left, just the main tree.
