I don't know if 'eminent domain' applies to this situation at all. I would agree with you for the 'right of way' law. But I don't think that unless they currently had a 'right of way' through where they dug(right through a boiler line between a boiler and a home) which I doubt. Either way I believe that they would have needed to have a signed agreement from the land owner for permission. If no permission and they needed access they would have needed to go trough some sort of court system.

That's what I thought wow . As it turns out I hear the sub has a new pipe on order. I haven't seen it yet but talk about a perfect screw up. The guy that was handed my problem then had an out of town emergency , then never got back to me so believe you me that company was getting about as bad a rap as you could get to any one who would listen. Then once I finally emailed for the third time (thanks for the suggestion by the way) I got a call apologizing and letting me know they have tubing on order. So we will see. Thanks
